European Commission adopts delegated regulation on EMIR active account requirements

The European Commission has adopted a delegated regulation supplementing article Article 7a of the European Market Infrastructure Regulation (Regulation (EU) No 648/2012) (EMIR) (as introduced by Regulation  (EU 2024/2987) (EMIR 3)) containing regulatory technical standards (RTS) for active account requirements. The delegated regulation implements EMIR 3 provisions intended to reduce financial stability risks from EU exposure to third-country central counterparties by requiring certain counterparties to maintain operational active accounts at EU CCPs. The rules establish operational conditions including IT connectivity and stress testing requirements, representativeness obligations for euro and Polish zloty interest rate derivatives, and six-monthly reporting requirements to competent authorities.

EBA publishes CRR final draft RTS on CVA risk of securities financing transactions

The European Banking Authority (EBA) has published its final draft regulatory technical standards (RTS) made under ​Article 382(6) of the Capital Requirements Regulation (Regulation (EU) No 575/2013) (CRR) specifying the conditions and criteria for assessing whether credit valuation adjustment (CVA) risk exposures arising from fair-valued securities financing transactions (SFTs) are material. The RTS also define the frequency of this assessment.

Commission updates ESMA fee rules for third country benchmark endorsement

The European Commission has adopted a delegated regulation amending Delegated Regulation (EU) 2022/805 to establish supervisory fees for EU benchmark administrators that endorse third-country benchmarks. The amendment follows the implementation of Regulation (EU) 2025/914, which amended the Benchmarks Regulation (Regulation (EU) 2016/1011) by expanding the European Securities and Markets Authority’s (ESMA’s) supervisory mandate to include this new category of administrators. The updated rules align the fee framework for these administrators with that applicable to recognised third-country administrators, ensuring consistency and proportionality. They introduce fixed fees for administrators endorsing non-significant benchmarks, reducing reporting obligations for smaller entities. The regulation should apply urgently to prevent legal uncertainty before the 31 December 2025 transitional deadline and will enter into force the day after its publication in the Official Journal of the European Union.

Financial Ombudsman Service reports continued fall in new cases in Q2 2025/26

The Financial Ombudsman Service (FOS) has reported a continued fall in the number of new cases it received in the second quarter of 2025/26. Between July and September 2025, the FOS received 46,300 new complaints, a decrease of more than a third compared with 73,700 in the same period of 2024/25. The drop follows the introduction of case fees for professional representatives earlier this year.
