An application to amend an equal pay claim to change, or add to, the claimant’s role (to rely on different work that she also carried out) changes the basis of the claim being made and therefore amounts to an application to amend to add a new claim, to which the principles in Selkent apply, including whether the claim has been brought in time or not. EAT: 2 Sisters Food Group v Abraityte.
