PII and negligence—law firms

This subtopic is intended for law firms regulated by the SRA, including sole practices. It reflects the requirements in the SRA Standards and Regulations relating to professional indemnity insurance (PII) and negligence. This subtopic is not intended for in-house lawyers or freelance solicitors.

Requirement to have PII

Law firms regulated by the SRA must take out and maintain qualifying PII with a participating insurer that provides adequate cover in respect of current or past practice, taking into account any alternative arrangements the firm or its clients make. They must also ensure that their PII provides adequate and appropriate cover in respect of services the firm provides

SFO secures £1.1m in first Unexplained Wealth Order case

The Serious Fraud Office (SFO) has secured £1.1m through its first successful use of an Unexplained Wealth Order (UWO), following the sale of a Lake District property in April 2025. The property belonged to Claire Schools, ex-wife of Timothy Schools who was convicted of investment fraud in 2022. The UWO was granted by the High Court in January 2025 after investigators traced criminal funds from Schools' multi-million-pound investment scheme fraud to the property purchase. The SFO's investigation into Timothy Schools' assets is ongoing, with the next hearing scheduled for 26 September 2025 at City of London magistrates' court.

FCA unit tells legal, accountancy bodies to improve SARs

Law360, London: The Office for Professional Body Anti-Money Laundering Supervision (OPBAS), which is housed within the Financial Conduct Authority (FCA), told legal and accountancy supervisory bodies on 8 September 2025 that suspicious activity reports (SARs) they submit could be improved by setting out an action plan.

OFSI issues first counter-terrorism sanctions breach disclosure against Vanquis Bank

Office of Financial Sanctions Implementation (OFSI) has issued its first disclosure notice under section 149(3) of the Policing and Crime Act 2017 against Vanquis Bank Limited for breaching the Counter-Terrorism (Sanctions) (EU Exit) Regulations 2019. The breaches occurred when the bank failed to restrict a designated person's account for eight days following designation, allowing a £200 cash withdrawal and an £8.99 transaction. OFSI assessed the breach as moderately severe, citing operational resilience failures in sanctions screening processes, though not serious enough to warrant a monetary penalty. The case establishes precedent for OFSI's use of disclosure notices in counter-terrorism sanctions enforcement and emphasises requirements for rapid account restriction following designation.

FATF launches handbook on international money laundering cooperation

The Financial Action Task Force (FATF), along with the Egmont Group, INTERPOL and the United Nations Office on Drugs and Crime (UNODC), has published a handbook providing guidance on cross-border money laundering investigations.
