Article summary

A report by The Lord Chancellor, Lord Chief Justice, and the Senior President of Tribunals, and a consultation by the Ministry of Justice, on the way in which the courts and tribunals in England and Wales should be reformed, have been published by the Ministry of Justice. They suggest speeding up resolution by replacing paper and post with online digital processes where possible. They also propose to extend the fixed recoverable costs regime to as many civil cases as possible. In so far as employment tribunals are concerned, the consultation simply states that consideration is being given to whether the new approaches to be adopted elsewhere could be implemented in the employment jurisdiction. There is also a separate consultation by the Ministry of Justice on modernising judicial terms and conditions, including a proposal for a single fixed-term for new fee-paid judges.
