To comply with the statutory requirement to ballot all those members who it is reasonable at the time of the ballot for the union to believe will be induced by the union to take part in the proposed industrial action, the union must include not only those it believes will withdraw their labour in breach of contract, but also those it believes will associate themselves with that action, by attending at a picket line, or by involvement in other activities done by those taking the action with a view to furthering their aims, according to the High Court in London Underground v Associated Society of Locomotive Engineers and Firemen.
