FORTHCOMING CHANGES: The Information Commissioner’s Office (ICO) published draft guidance on recruitment and selection, which was open for consultation until 5 March 2024, and removed the employment practices code (first published in March 2022, and last updated in November 2011) and supplementary guidance from its employment information page. For more information, see Practice Note: The UK GDPR and DPA 2018: key data protection issues for employment lawyers—Information Commissioner's Office (ICO) guidance. This Practice Note will be updated in due course. |
This checklist provides a summary of the factors that an employer should consider before, and during, the recruitment process. It takes account of the Employment practices code (Code) issued by the Information Commissioner's Office (ICO) and the supplementary guidance to the Code, although these have not been updated to take account of Assimilated Regulation (EU) 2016/679, UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 (DPA 2018). For information on the ICO’s plans for an Employment Practices Hub, and consultations launched to date in respect of draft guidance, see Practice Note: The UK
