Article summary

The Government has published its response to the consultation on how to prevent employers evading the ban on exclusivity clauses in zero hours contracts. The Government has proposed regulations which: (1) provide that exclusivity terms in those contracts where an individual is guaranteed less than a certain level of weekly income will be unenforceable, (2) include the right for zero hours workers to not suffer detriment if they work or perform services for someone else, and (3) enable an employment tribunal to make a declaration and/or award compensation if a complaint of detriment is upheld.
