The DWP is consulting on a proposal to exempt employers from the duty automatically to enrol an employee in an occupational pension scheme in cases where the employee works in another EEA state as well as the UK, and so is subject to the social and labour law relevant to the field of occupational pension schemes of that other EEA state, because, in such cases, owing to legal requirements affecting cross-border schemes, there may be no pension scheme available which is willing or able to accept that employee as a member, making it impossible for the employer to comply with its automatic enrolment duties.
