On 22 January 2020, Advocate General Kokott delivered her opinion in Case C-307/18 Generics (UK) and Others, a national reference from the UK concerning the application of Articles 101 and 102 TFEU in relation to pay-for-delay patent settlement agreements. The Advocate General proposed (among other things) that such agreements may constitute a restriction of competition by object or effect and an abuse of a dominant position.
