162.3 Public health and safety etc

Notwithstanding anything in the provisions of Section 1 of the Wildlife and Countryside Act 19811 or in any order made under Section 3 of that Act2, an authorised person3 will not be guilty of an offence by reason of the killing or injuring of any wild bird, other than a bird included in Schedule 1, if he shows that his action was necessary for the purpose of:

  1. 162.3.1

        preserving public health or public or air safety;

  2. 162.3.2

        preventing the spread of disease; or

  3. 162.3.3

        preventing serious damage to livestock, foodstuffs for livestock, crops, vegetables,
