165 Exceptions to the prohibitions on methods of killing

165.1 Traps set for pests

In any proceedings under the Wildlife and Countryside Act 1981 Section 5(1)(a)1(use of traps etc) it is a defence to show that the article was set in position for the purpose of killing or taking, in the interest of public health, agriculture, forestry, fisheries or nature conservation, any wild animals which could be lawfully killed or taken by those means and that all reasonable precautions to prevent injury to wild birds were taken2.
