SCC publishes practice note reviewing emergency arbitrator decisions 2023–25
The Stockholm Chamber of Commerce Arbitration Institute (SCC) has published a new practice note summarising emergency arbitrator decisions from 2023 to 2025. It notes that the mechanism, first introduced in 2010, continues to apply a high threshold for urgent interim relief. Between 2023 and 2025, the SCC received 11 applications, with decisions reflecting rigorous scrutiny of prima facie case, irreparable harm, urgency and proportionality, and showing that irreparable harm remained the most challenging requirement. The practice note also reports improved procedural efficiency, with 80% of decisions issued within five days, increasing diversity among disputes and participants, and marks 15 years of the SCC’s emergency arbitration mechanism as a tool for urgent relief.
