Arbitration analysis: This is a short summary of the recently published October 2017 judgment of the Svea Court of Appeal in Belgorkhimprom v Koca Insaat Ihracat, in which the court annulled part of an arbitration award made by a tribunal in Stockholm on 3 April 2015 under the rules of the Arbitration Institute of the Stockholm Chamber of Commerce (SCC). The arbitration arose out of a mineshaft construction agreement and the court held that certain work orders carried out after termination of the agreement were not covered by an arbitration clause in that agreement. The tribunal had thus decided an issue which was not covered by a valid arbitration agreement between the parties.
