Construction analysis: Miss Nerys Jefford QC in the Technology and Construction Court (TCC) held that, under a DOM/2 subcontract, an extension of time was to be added to the date for completion even where that date had already passed. The court rejected the argument that additional time should run from the occurrence of the event giving rise to the entitlement. It also held that the main contractor’s liability for liquidated damages (LADs) to its employer had not been extinguished by a supplemental agreement.
