Competition weekly highlights—5 December 2024
This week's edition of Competition weekly highlights includes, from a UK perspective: (1) the provisions relating to the new digital markets competition regime and changes to the UK merger control under the DMCCA 2024 coming into force on 01/01/2025, (2) publication by the DBT of the government’s response to a consultation on turnover and control regulations, which have now been finalised and laid before Parliament, (3) publication of two further SIs for the purposes of the DMCCA 2024, (4) publication by the CMA of a document setting out the government's plan for monitoring and evaluating the new pro-competition regime for digital markets, (5) a High Court judgment dismissing a judicial review relating to a Government order requiring Russian-backed investment firm to sell broadband provider under the NSI Act 2021, and (6) a CAT judgment dismissing an application for summary judgment concerning an action against Microsoft alleging breach of competition law. This week's highlights also includes, from an EU perspective: (1) the Commission’s decision to withdraw its guidance on Article 22 merger referrals, (2) the Commission’s decision to fine Pierre Cardin and Ahlers €5.7m for restricting cross-border sales of clothing, and (3) the Commission’s decision to close its State aid investigation into Fiat, Amazon and Starbucks tax rulings.
