Planning analysis: In Preston New Road Action Group v Secretary of State for Communities and Local Government, the High Court dismissed two appeals under section 288 of the Town and Country Planning Act 1990 (TCPA 1990) against a decision by the Secretary of State for Communities and Local Government (SCLG) to grant planning permission for exploratory fracking works and related development at land to the north of Preston New Road in Lancashire.
