With effect from 3 January 2012 Natural England has power to apply civil sanctions where appropriate as an alternative to criminal prosecution. It may also accept voluntary ‘enforcement undertakings’ giving an offender the opportunity to make an offer to take steps to correct its behaviour and remedy effects on the environment.
