Article summary
This week, we reported the Court of Appeal’s decision in Miller, in which it provided valuable guidance on how to approach hearsay evidence and the importance of providing the context for such evidence. We also reported another Court of Appeal decision, Mortgage Agency Services, in which the court struck out a bank's claim for costs of funding where it hedged interest rate costs in lending against secured property and the valuation of the secured property was subsequently accepted to have been negligent. We continue to focus on providing a roundup of key news stories from the last week, highlighting their practical implications, as well as updating our Practice Notes to ensure you are kept up to date.
