CPR changes and 192nd practice direction update—31 December 2025

Changes are provided for in the Civil Procedure (Amendment No 3) Rules 2025, SI 2025/1229 which come into force on 31 December 2025. The rules amend CPR 77, provisions which support criminal justice. The rules insert a new section setting out the procedure to be followed where, under section 32ZAA of the Crime (Sentences) Act 1997 or section 256AZBA of the Criminal Justice Act 2003, the Secretary of State directs the Parole Board to refer its direction to release a prisoner to the High Court. The rules also set out the procedure for applying for non-disclosure of information which would adversely affect the prevention of disorder or crime, or the health or welfare of the defendant or any other person.

The government has extended rental trials until May 2028 under its Road Safety Strategy to build an evidence base for future legislation, while private e-scooters remain legal to purchase but illegal to use on public roads. Despite widespread use and police enforcement through confiscations, promised regulatory reforms have stalled since 2022.

MoJ publishes minutes of October 2025 OIC Advisory Group meeting

The Ministry of Justice (MoJ) has published the summary minutes of the Official Injury Claim (OIC) Advisory Group meeting held on 28 October 2025. The minutes cover updates on Official Injury Claim data and performance, the Whiplash Reform Programme post-implementation review and member feedback, with attendees including the Motor Insurers’ Bureau, HM Courts and Tribunal Service and the Civil Procedure Rule Committee. The meeting confirmed ongoing work to address procedural issues in some courts and system updates to tackle dormancy and improve the professional user experience within the OIC portal. It also confirmed that the next quarterly data release will be issued in January and the next Advisory Group meeting scheduled for April 2026.

Law Society supports OPRC's first Online Procedure Rules for possession proceedings

The Law Society of England and Wales has expressed support for the Online Procedure Rule Committee's (OPRC) first Online Procedure Rules, which will initially apply to possession proceedings. In response to a consultation on the rules, the Law Society supports the OPRC's focus on access to justice through online proceedings while ensuring accessibility and inclusion are protected. The Law Society encourages the committee to take an iterative approach as more proceedings come within scope and to continue engaging with the legal profession as it contemplates extending online proceedings to other jurisdictions. Law Society president Mark Evans stated the draft rules are a positive first step for a digital justice system, but cautioned that simplicity must not compromise clarity and urged the OPRC to specify responsibilities for obligations created by the rules to avoid confusion for legal professionals and unrepresented participants.
