Information law analysis: The High Court has dealt with a number of procedural applications in the context of a claim for breach of confidence, misuse of private information and data protection, relating to recordings of the claimant engaged in embarrassing behaviour while intoxicated. In a judgment which highlights the importance of properly particularising such a claim, the court struck out the claimant’s response to a part 18 request and granted an unless order, requiring the claimant to serve draft amended statements of case and to seek permission to amend within 14 days, failing which the particulars of claim would be struck out and judgment entered for the defendants.
