Arbitration analysis: Tim Chelmick and Peter Morcos of 4 New Square discuss the recent amendments to the Rules of Arbitration of the International Chamber of Commerce (ICC Rules) in force from 1 March 2017. The most significant change is that the rules will offer an expedited procedure in ICC arbitrations which applies in certain circumstances (and in disputes worth less than US$2m). The parties can opt-out of the expedited procedure but, unless this is done in the relevant arbitration by party agreement, the new procedure will apply to arbitrations where the arbitration agreement is entered into after 1 March 2017.
