The European Data Protection Board (EDPB) has requested that the Irish Supervisory Authority (SA) amends its draft decision taken against WhatsApp Ireland Ltd (WhatsApp IE). Specifically, the EDPB has stated that the Irish SA should amend the calculation of the fine, the period for which WhatsApp IE must comply with its order, and its assessment of infringements of transparency. The EDPB’s request comes after the Irish SA notified WhatsApp IE of its final decision. The EDPB had previously adopted a binding decision on the matter on 28 July 2021, pursuant to Article 65 of the EU General Data Protection Regulation, Regulation (EU) 2016/679 (EU GDPR), owing to concerns raised by other Member States' supervisory authorities.
