The European Data Protection Board (EDPB) has adopted three dispute resolution binding decisions under Article 65 of the EU’s General Data Protection Regulation, Regulation (EU) 2016/679 (EU GDPR) in relation to Meta Platforms Ireland Ltd (Meta) and the legal issues arising out of the draft decisions of the Irish Data Protection Commission (DPC) regarding Facebook, Instagram and WhatsApp. Following a number of national supervisory authorities issuing objections in relation to the Irish DPC’s draft decision, the EDPB’s binding decision settles the question of whether or not the processing of personal data for the performance of a contract is a suitable legal basis for behavioural advertising and for service improvement.
