The CJEU has approved Advocate Nilo Jaakinen’s opinion that a jurisdiction clause within a sales contract concluded between a manufacturer and a purchaser, where the contract then formed a chain of contracts signed by parties in different Member States, could not be relied upon against a sub buyer of the goods or their insurers in a subrogated claim.
