46 Powers of compulsory purchase

A council1 may purchase land within or outside its area compulsorily for the purpose of providing allotments, provided that it has been authorised to do so by the Secretary of State or by the Welsh Minister2. Where the council proposing to acquire land compulsorily is a parish council (or, in Wales, a community council), the council must represent the case to the district council which may, on behalf of the parish (or community) council, and at that council’s expense, exercise the statutory powers of acquisition.
