60 Selection of tenants

A smallholding must, subject to the exceptions noted below, be let to a person who is to farm the holding, and who either is regarded by the smallholdings authority as being qualified by reason of his agricultural experience to farm the holding on his own account, or is a person whom the authority is satisfied will, within a reasonably short time, become eligible to be so regarded1.

No person, other than the surviving spouse or civil partner residing on the smallholding2 of the deceased tenant to whom the holding was let immediately
