6: NOTICE TO QUIT

69 General

The rules relating to a notice to quit a smallholding depend on whether the tenancy is governed by the Agricultural Holdings Act 1986 or the Agricultural Tenancies Act 1995. However, generally a notice served under either Act must relate to the whole holding unless the contract provides otherwise, or the landlord’s reversion has been severed1.

In the case of an Agricultural Holdings Act tenancy there are, however, statutory exceptions allowing a notice to quit of part2. Such exceptions arise where the notice to quit states that it is given
