74 Farm business tenancies—notice to quit

If the tenancy of a smallholding begins on or after 1 September 1995 and is subject to the Agricultural Tenancies Act 1995, a notice to terminate the tenancy is not needed if it is a fixed-term tenancy of two years or under. The tenancy expires automatically on the term date.

A notice of at least 12 months is required to terminate a tenancy of over two years1. A break clause in a fixed-term tenancy of over two years will operate only if notice of at least 12 months has first been served
