9: ACQUISITION OF LAND FOR SMALLHOLDINGS

77 Powers of acquisition

A smallholdings authority may only acquire land by agreement1. It has no powers of compulsory acquisition. Where such an authority proposes to acquire land outside its area for the purposes of smallholdings in the exercise of its power to acquire land by agreement, it must consult the council of the county or county borough in whose area the land is situated2.

The Secretary of State and the Welsh Minister also have power to acquire by agreement any land which in their opinion is required by them
