Court dismisses EIA and apparent bias challenges to development consent order and applies Gateshead principle to EIAs (R (Associated Petroleum Terminals (Immingham) Ltd and another) v Secretary of State for Transport))

Planning analysis: The claimants challenged a development consent order (DCO) granted for the Immingham Eastern ‘roll-on roll-off’ Terminal (IERRT), a major ferry terminal project at the Port of Immingham. The High Court dismissed the challenge, confirming that the environmental statement (ES) was adequate and that the assessment of adequacy falls on the decision maker and not the court unless it is Wednesbury unreasonable. The judge also endorsed the SoS’s reliance on the ‘River Regime’ to manage any navigational risks that the ES could not assess. Chief Planner’s planning update newsletter for August 2025 published

The Chief Planner, Joanna Averley, has published a planning update newsletter for August 2025, written for the chief planning officers at local planning authorities (LPAs). The newsletter contains details of preparations for the new plan-making system, with the Ministry of Housing, Communities and Local Government (MHCLG) urging LPAs to ensure full coverage of up-to-date local plans as soon as possible. It outlines five non-statutory activities LPAs can currently undertake to prepare for the new system under the Levelling Up and Regeneration Act 2023 (LURA 2023), including early scoping work, evidence base development, engagement preparation, project management development and risk monitoring processes. The newsletter also highlights that MHCLG has provided further details on the steps it will take to reform the statutory consultee system, including introducing a national planning fee surcharge to fund statutory consultees’ planning functions via the Planning and Infrastructure Bill. MHCLG is also expected to consult soon on removing statutory consultee status from Sport England, the Theatres Trust and the Gardens Trust. Additionally, the newsletter covers the launch of the Planning Advisory Service (PAS) fees survey, the publication of PAS’ best practice self-assessment toolkit to help councils review their planning committees and the government’s decision to maintain maximum and minimum compulsory purchase thresholds for owner-occupiers.

Defra announces environmental planning reforms

The Department for Environment, Food and Rural Affairs (Defra) has announced a package of environmental planning reforms, implementing recommendations from Dan Corry's independent review of Defra's regulatory framework. A key measure is the introduction of a Lead Environmental Regulator model—first being piloted on the Lower Thames Crossing project, a new road crossing connecting Kent, Thurrock and Essex. Natural England will serve as Lead Environmental Regulator for the project, collaborating with the Environment Agency and the Marine Management Organisation. The reforms also establish a Defra Group Infrastructure Board to oversee and expedite the planning process for 50 major infrastructure projects, including Hinkley Point C, East West Rail and Heathrow expansion, as well as renewable energy projects critical to meeting the 2030 clean power mission, such as offshore wind and solar farms and electricity transmission lines. The Board will not pre-empt or influence the consenting process, which remains the responsibility of the Planning Inspectorate. Backed by £500m, the reforms also include funding for the Nature Restoration and Marine Recovery Fund schemes and resources to build capacity within the planning system. The overall aim is to accelerate planning processes for infrastructure and housing delivery while maintaining environmental protections.
