Arbitration analysis: The court considered an application by the British Boxing Board of Control (the Board) to strike out an application by one of its former licensed boxing promoters. The Board’s position was that the appeal proceedings that had already taken place were an arbitration under the Arbitration Act 1996 (AA 1996) and, as such, the promoter could not now apply to the court to have those proceedings dismissed as unlawful. The Master found that the appeal proceedings were an arbitration within AA1996 following the test set out in England and Wales Cricket Board v Kaneria.
