Article summary

Justice of the UK Supreme Court, Lord Sales has spoken at the Information Law Conference on 24 April 2023 about Information Law and automated governance in a keynote address. Lord Sales highlights how government is becoming increasingly automated which has improved speed, efficiency and cost, however it also brings problems and challenges. Lord Sales first addresses the benefits and risks of automated governance, then the tensions in regulating automated decision-making, how the common law will apply to regulate adoption and design of automated systems by public bodies and operation of these systems in individual instances. Lord Sales then makes four observations about duties applicable to operating an algorithmic system as well as the challenge arising in individual cases. Lord Sales concludes by saying that such technology in administration will need insight and expertise of lawyers who understand Administrative Law and Information Law.
