The Commercial Court in its judgment dealing with a jurisdictional dispute arising out of the collapse of the Icelandic bank Kaupthing considered a number of issues including (1) how to determine the relevant jurisdictional agreement when the parties have entered into a number of agreements containing different jurisdiction clauses (2) the application of article 17 of the Lugano Convention in relation to jurisdiction clauses conferring the benefit of the clause on only one of the parties to the agreement and (3 ) forum non conveniens.
