The claimants failed to file their original cost budgets on time, and thus were sanctioned such that their budgets were limited to applicable court fees. Following the increase in the trial timetable, the claimants applied to revise their costs budgets in respect of the increased time estimate. Those revisions were allowed. On appeal, objection was taken on the basis that such revisions usurped the sanction applied for the original failure to file budgets on time. That appeal was dismissed.
