The Information Commissioner’s Office (ICO) has announced the Court of Appeal (CA) ruling in The 3Million case, R (On the Application Of) v Secretary of State for the Home Department [2023] EWCA Civ 1474, which held that the government must make changes to the immigration exemption in the Data Protection Act 2018 (DPA 2018) for greater clarity. The ruling requires the government to set out safeguards around how people can access the information held about them.
