The European Commission has sent AliExpress a formal request for information on the measures it has taken to comply with its obligations as a Very Large Online Platform, under the EU Digital Services Act (EU DSA). In particular, the Commission wants to investigate AliExpress’ assessment and mitigation measures to protect its consumers from illegal products such as fake medicines being sold online. AliExpress’ deadline to submit the information is 27 November 2023. The Commission can impose fines for incorrect, incomplete, or misleading information provided by AliExpress, pursuant to Article 74(2) of the EU DSA. Based on the assessment of AliExpress’ replies, the Commission will assess next steps which can include formal proceedings under the EU DSA.
