The European Securities and Markets Authority (ESMA) has launched a consultation on proposed changes to Article 28 of Commission Delegated Regulation (EU) No 153/2013, supplementing EU EMIR. In particular, the changes relate to the anti-procyclicality (APC) margin measures that apply to central counterparties (CCPs) and the policies and procedures for selecting and reviewing the APC margin. Proposals are intended to include a potential right for CCPs to define their own APC thresholds for margin changes, based on their risk appetite/tolerance. The consultation closes on 31 March 2022.
