The Advertising Standards Authority (ASA) has added a new Appendix to the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing (CAP Code) following the announcement that, from 7 December 2021, the ASA will join Ofcom as a co-regulator of video-sharing platform (VSP) controlled advertising which appears on UK-regulated VSP services. No new requirements for VSPs are introduced in the Appendix, instead, it mirrors the requirements for VSP advertising which have been in place since November 2020 to ensure that the ASA can take action on suspected breaches against VSP providers without asking Ofcom to use its statutory enforcement powers. Only those services that are subject to statutory regulation under Part 4B of the Communications Act 2003 are subject to the new Appendix.
