Arbitration analysis: In its recent judgment of 15 February 2017, the Spanish Supreme Court has upheld the annulment of an arbitral award for violation of the principle of collegiality of the arbitral tribunal. In a very unusual decision, the Supreme Court has declared two arbitrators professionally liable and ordered them to reimburse part of their fees, plus interest and costs. Joe Tirado, partner (London), and Pedro Tent Alonso, principal associate (Valencia) at Garrigues examine the case.
