Ofgem publishes final determinations on NESO’s Business Plan 3

Ofgem has published its final determinations on the National Energy System Operator (NESO)’s Business Plan 3 (BP3), setting out its expectations for NESO’s performance, reporting requirements, and position on how the plan delivers value for money to consumers. The final determinations confirm the positions outlined in Ofgem’s earlier draft, including the performance metrics NESO should use to measure success. Ofgem will evaluate NESO’s performance under BP3 in a Performance Assessment Report, expected to be published in summer 2026.

Three gas distribution operators to pay £8m over emergency response failures

Ofgem has concluded its August 2024 investigation into three gas distribution network (GDN) operators—Cadent Gas Limited (Cadent), Scotland Gas Networks Plc (SGN Scotland), and Southern Gas Networks Plc (SGN Southern)—following their failure to meet emergency response targets during 2022–23. The companies self-reported breaches of Standard Special Condition D10 2(h), which requires 97% of gas emergencies to be attended within one to two hours. They have voluntarily agreed to pay a total of £8m to the Energy Industry Voluntary Redress Fund. Cadent will pay £1.5m, SGN Scotland £700,000, and SGN Southern £5.8m.

Commission proposes two year delay to batteries due diligence rules

The Commission has published a proposed amendment to Regulation (EU) 2023/1542 (the Sustainable Batteries Regulation) to delay the application of the due diligence obligations set out in the Regulation’s Chapter VII by two years.

DESNZ publishes exemptions request notice for CfD AR7

The Department for Energy Security and Net Zero (DESNZ) has published an exemptions request notice under the Contracts for Difference (CfD) (Allocation) Regulations 2014, SI 2014/2011. The notice outlines the process that excluded generators—those who have either allowed CfD offers to lapse or had CfDs terminated—must follow to apply for an exemption from their temporary site exclusion, to be eligible to participate in Allocation Round 7 (AR7), which is scheduled to open in August 2025. It also sets out: (1) the information required for an exemption request; (2) the deadline for submitting a request for an exemption certificate to the Secretary of State for Energy Security and Net Zero; and (3) where such requests should be sent.
