This subtopic contains a range of resources focussing on some of the key pre-procurement considerations from the viewpoint of suppliers to public authorities, with particular focus on public procurement under the Public Contracts Regulations 2015 (PCR 2015), SI 2015/102.

Public procurement law reform

Review and reform of the domestic public procurement regime, and associated areas of regulation (including health procurement and subsidy control—which replaces State aid), is on the government’s agenda as part of the post-Brexit dividend allowing for development of a bespoke regime for the UK. The domestic public procurement regime in England, Wales and Northern Ireland comprises the following sets of regulations:

the Public Contracts Regulations 2015, SI 2015/102 (PCR 2015) addresses contracts awarded by central government, local authorities and other public sector bodies. The PCR 2015 implemented the EU Public Contracts Directive 2014/24/EU, and replaced the Public Contracts Regulations 2006, SI 2006/5. ICO launches consultation on enforcement procedural guidance

The Information Commissioner’s Office (ICO) has launched a 12-week consultation on draft enforcement procedural guidance, which aims to increase transparency arouns the ICO's investigation and enforcement processes under the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, including new powers under the Data (Use and Access) Act 2025 to require answers to questions and organisational reports. The guidance specifically explains when and how the ICO opens investigations, uses its information gathering powers, how enforcement decisions are made and how settlement with reduced fines may be appropriate. The consultation closes on 23 January 2026.

This week's edition of Commercial weekly highlights includes: judgment of the High Court in RMK Maritime (Europe) Ltd v Cmb.Tech NV where the court dismissed the claimants' restitutionary claim against the defendant for alleged mergers and acquisitions advisory work performed outside the scope of their written advisory agreement, news that the Advertising Standards Authority has announced that the Committee of Advertising Practice and the Broadcast Committee of Advertising Practice have agreed to remove energy labelling rules from their advertising codes and associated guidance, following a review and public consultation, and news that the Home Office has published non-binding guidance to help organisations strengthen their supply chain resilience against ransomware threats.

ASA rulings—29 October 2025

One complaint was received by the Advertising Standards Authority (ASA) concerning an in-app advert by WHG (International) Ltd t/a William Hill Online promoting its 'Marble Race Live' game. The ASA upheld the complaint.
