30 Definition of locatio custodiae

A bailment by way of locatio custodiae arises where a bailee agrees to store the goods of another in return for some advantage. The bailee’s advantage may be monetary or may comprise some other benefit1. Where, for example, a restaurant provides facilities for the leaving of customers’ cars2 or the deposit of garments3, in circumstances which place the restaurant in possession4, the restaurant is a bailee for reward.
