32.2 Acts of employees

The bailee is answerable for the negligence of his employees in the course of their employment1, and for any deliberate wrong committed by an employee to whom the bailee has entrusted the goods and delegated any part of his duty of care2. Such wrongs include malicious damage, and theft or complicity in theft. However, the bailee is not responsible for a theft by an employee to whom the goods were not entrusted, whose employment merely afforded that employee the opportunity to commit the theft3.
