22 Defective notices

A defective notice or the defective service of a notice is not necessarily fatal to the status of a farm business tenancy. Provided that the agriculture condition1 is complied with at the outset, and at the time of challenge, and provided that part of the land has been farmed for the purposes of a trade or business throughout its life2, it will still be a farm business tenancy.
