35 Introduction to statutory rent review

If there is no provision as to rent review complying with the requirements of the Agricultural Tenancies Act 19951 and no other contractual choice which the parties agree to follow through, the statutory rent review machinery must be applied2. This requires the rent to be fixed at the open market level with minimal disregards (ie tenant’s fixtures or improvements, tenant’s actual occupation, tenant’s dilapidations)3.
