ICC publishes preliminary 2025 dispute resolution statistics

The International Chamber of Commerce (ICC) has published its preliminary dispute resolution statistics for 2025, reporting 894 new cases and a record 1,869 pending cases at year-end. During the year, it received 30 emergency arbitrator applications and administered 169 new expedited cases. The ICC also published a report, toolkit and factsheet reviewing nearly 800 expedited proceedings. A total of 2,531 parties from 147 jurisdictions were involved in 2025 cases, and arbitrations were seated in 123 cities across 70 countries. The top ten seats were France, the UK, Switzerland, Singapore, Brazil, Spain, Germany, Mexico, the United Arab Emirates and the US. The ICC states that the aggregate value of pending cases stood at US$299bn, with disputes ranging from just below US$2,500 to US$31bn. It also notes that 607 awards were approved during the year. The full 2025 ICC Dispute Resolution Statistics report will be published later in 2026.

HKIAC publishes 2025 caseload statistics

Hong Kong International Arbitration Centre (HKIAC) has released its 2025 statistics, reporting 582 new cases, including a record 388 arbitrations, its highest ever number and a 10% increase on 2024’s 352, alongside nine mediations and 185 domain name disputes. The total amount in dispute in arbitration cases was HK$126.2bn, and 84.3% of arbitrations were international in nature. Corporate disputes accounted for the largest share of cases (23.6%), followed by maritime disputes (19.9%) and sale of goods disputes (14.2%). The data also shows 410 arbitrator appointments and confirmations during the year, a slight decrease from 419 in 2024, and covers interim measures applications, emergency arbitrator applications and expedited procedures.

Cayman Court of Appeal maintains a pro-arbitration stance (IGCF General Partner et al v White Crystals Ltd)

Arbitration analysis: The Cayman Islands Court of Appeal has recently delivered a decision reiterating the Cayman Islands’ pro-arbitration stance, dismissing an appeal brought by a general partner seeking to overturn a first instance decision staying proceedings brought in the Cayman Islands in favour of claims brought by certain limited partners in an LCIA arbitration. This decision once again highlights the pro-arbitration stance of the court in the Cayman Islands and confirms that absent very limited exceptions or an abuse of process, parties will be bound by their contractual obligation to arbitrate.
