Procurement Act 2023

As of 24 February 2025, the main provisions of the Procurement Act 2023 (PA 2023) are in force. Procurements begun on or after this date must be carried out under PA 2023 (where applicable), whereas those begun under the previous legislation (the Public Contracts Regulations 2015, SI 2015/102, the Utilities Contracts Regulations 2016, SI 2016/274, the Concession Contracts Regulations 2016, SI 2016/273, and the Defence and Security Public Contracts Regulations 2011, SI 2011/1848) must continue to be procured and managed under that legislation. Welsh Government publishes Annual Report on Equality and Human Rights 2025

The Welsh Government has published and laid before the Senedd its Annual Report on Equality and Human Rights 2025, covering the period from 1 January 2024 to 31 March 2025. The report fulfils statutory reporting requirements under the Government of Wales Act 2006, the Equality Act 2010, the Public Sector Equality Duty and the Welsh Specific Equality Duties. It reflects on actions to support the Strategic Equality Plan 2020-2024 while introducing concepts for the successor Strategic Equality and Human Rights Plan 2025-2029. The report incorporates an overview of how public sector organisations have performed against the Public Sector Equality Duty, with the Equality and Human Rights Commission continuing to act as the formal regulator. The Welsh Government has committed to a human rights approach that aims to respect, protect and fulfil human rights and equality duties to enable everyone in Wales to live with dignity, freedom, security and without discrimination.

Lord Sales defends Supreme Court's approach to the principle of legality and heightened scrutiny

In a speech to judges, Lord Sales has defended the doctrinal distinction made by the Supreme Court in public law between the interpretative principle of legality, and heightened scrutiny. He was responding to academic comment from Professor Mark Elliott of Cambridge University.

JCSI publishes 40th report of Session 2024–26

The Joint Committee on Statutory Instruments (JCSI) has published its 40th report of Session 2024–26. Two instruments were drawn to the special attention of the House: the Criminal Procedure Rules 2025, SI 2025/909, reported for doubt as to vires in two respects and for defective drafting in one respect, and the Street and Road Works (Charges and Penalties) (Amendments) (England) Regulations 2025, SI 2025/1074, reported for requiring elucidation.

Institute for Government analyses legal implications of Labour asylum reforms

The Institute for Government has published a legal analysis examining potential court challenges to the Labour government's proposed asylum system reforms. The analysis, conducted by former Government Legal Department permanent secretary Sir Jonathan Jones, identifies several areas vulnerable to litigation under the European Convention on Human Rights (ECHR). Key concerns include proposals to replace mandatory asylum seeker support with discretionary provision, which may breach Article 3 ECHR's absolute prohibition on inhuman or degrading treatment. The analysis warns that plans to resume removals following regime changes could violate non-refoulement principles without case-by-case safety assessments. Additional legal risks are identified in proposals to create a new appeals body with potentially limited judicial review, and measures to narrow Article 8 ECHR scope through strengthened public interest tests, restricted family member definitions, and limited claim procedures. The analysis notes that while the Immigration Act 2014 previously introduced similar Article 8 restrictions, further limitations increase the likelihood of successful Human Rights Act challenges and potential incompatibility declarations by UK courts.
