Pre-action protocols

There are a number of pre-action protocols relating to specific types of personal injury claims which set out the conduct expected of the parties and the steps the court would normally expect parties to take before commencing proceedings. You should follow the protocol that most closely relates to the subject matter of the dispute. If there is no protocol for the type of dispute you are dealing with, you should refer to the Practice Direction Pre-Action Conduct and Protocols (the Practice Direction).

The limitation period is not suspended while parties comply with a pre-action protocol or the Practice Direction. If the limitation period is about to expire, protective proceedings should be issued and either party should then apply to stay the action in order to allow time for compliance with the relevant pre-action protocol or the Practice Direction.

Costs of unsuccessful claimant ordered against defendants for failed allegation of fundamental dishonesty (Hakmi v East & North Hertfordshire NHS Trust & another)

PI & Clinical Negligence analysis: The defendants were ordered to pay a proportion of the claimant’s costs from the time the issue of fundamental dishonesty was raised in the defendants’ counter schedule of loss. It was otherwise ordered that the claimant pay the defendants’ costs of the action, not to be enforced without leave of the court. The court’s decision on costs is a rare outcome where a claimant who is unsuccessful is nonetheless awarded their costs of the claim. Could the decision be viewed as a peculiarity arising from the application of qualified one-way costs shifting (QOCS)? Or is the decision a development in cases of failed allegations of fundamental dishonesty being an exception to the general rule that the unsuccessful party will be ordered to pay the costs of the successful party? IOPC publishes Hillsborough investigation findings on police conduct and misconduct

The Independent Office for Police Conduct (IOPC) has published a report summarising investigations into police conduct during the Hillsborough disaster and its aftermath. The IOPC conducted 161 separate investigations into 352 complaints, finding that South Yorkshire Police's Chief Constable and nine other officers would have faced gross misconduct cases if still serving, while two West Midlands Police senior officers would also have faced gross misconduct proceedings for bias in their investigation of the disaster.
