Article summary

Dispute Resolution analysis: Deputy District Judge Lingard made a wasted costs order, with costs to be assessed on an indemnity basis, and in doing so expressed extreme displeasure with the solicitors and their conduct of the matter. The central issue concerned the statement of truth in a claim form which the solicitor had signed with no authority and which was ‘manifestly incorrect’. Despite the fact that it was clear from documents in the file that the costs should not be claimed, the claim was maintained through to trial.
