The QBD has granted a claimant relief from sanction where the claimant’s claim had been automatically struck out for failure to comply with an unless order to pay costs. Of particular interest in this judgment are various other issues, including the re-listing of the trial in the light of counsel’s unavailability, the court’s interpretation of the payment deadline in the unless order and steps it was proper for a party to take in the face of an automatic strike out of their opponent’s case.
